Terms of Service (Terms of Use)

Welcome to Jewellaire (“Jewellaire,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of Jewellaire.com (the “Site”) and any related services, content, features, tools, and products we provide (collectively, the “Services”).

By visiting, browsing, or making a purchase through the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.


1) Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Services and place an order.


2) Account & Accuracy of Information

You may create an account to access certain features. You agree to provide accurate and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

We may refuse, suspend, or terminate accounts or access to the Services if we believe there is fraud, abuse, or violation of these Terms.


3) Products, Availability & Presentation

We make reasonable efforts to display product information accurately. However:

  • Product photos may appear different depending on lighting, screens, or device settings.

  • Product descriptions, pricing, and availability may be updated at any time.

  • We may limit quantities per order or per customer, and we may discontinue products at any time.


4) Orders & Acceptance

Placing an order is an offer to purchase. We reserve the right to accept, decline, or cancel any order at our discretion, including for suspected fraud, pricing errors, inventory issues, or order verification needs.

Your order is not accepted until we confirm it and payment is successfully processed.


5) Pricing Errors & Corrections

If a product is listed with an incorrect price or incorrect information due to an error, we may correct the error and:

  • cancel the order, or

  • contact you with options (where reasonable).


6) Payment & Buy Now Pay Later (BNPL)

We accept multiple payment methods, including third-party installment providers such as Sezzle, Klarna, Afterpay, and Affirm (where available).

  • Payment processing is handled by third-party providers.

  • If you choose a BNPL provider, your payment agreement is between you and that provider, and refunds/adjustments may follow the provider’s processing timelines and policies.


7) Shipping, Delivery & Risk of Loss

Shipping timelines are estimates and not guaranteed. Delays may occur due to carriers, weather, customs, or other events outside our control.

Risk of loss and title pass to you once the package is handed to the carrier (to the extent permitted by law).

United States

  • Free Shipping: 4–6 business days

  • Standard Shipping: 3–5 business days

  • Rush Shipping: 1–3 business days

  • Express Shipping: 1 business day*

Canada

  • Free Shipping: 6–12 business days

  • Rush Shipping: 1–3 business days*

Rush/Express Processing Rule:
Orders placed Mon–Sat before 12:00 PM PST ship the same day (excluding Sundays and federal holidays). Orders placed after 12:00 PM PST on weekends ship Monday.

* Express shipping is not available in all locations. Deliveries exclude weekends and major holidays.

International duties/taxes (if applicable) are calculated at checkout when shown and you should not be billed upon delivery where duties are prepaid.


8) Made-to-Order Option

Some products offer a Made-to-Order option at checkout.
If you select Made-to-Order, additional production time is required. Made-to-order items typically require 10–14 working days for crafting and dispatch before shipping.


9) Returns, Exchanges & Cancellations

Returns, exchanges, and cancellations are governed by our Return, Exchange & Cancellation Policy (posted on our Site). By placing an order, you agree to those terms, including eligibility rules and any applicable cancellation fees.


10) Prohibited Uses

You agree not to:

  • violate any laws or regulations

  • use the Services for fraud, abuse, harassment, or harmful conduct

  • attempt to hack, disrupt, overload, or interfere with the Site

  • scrape, crawl, or harvest data without written permission

  • upload malware, viruses, or malicious code

  • misuse discount codes, promotions, or payment methods

We may restrict or terminate access for violations.


11) User Content (Reviews, Messages, Submissions)

If you submit reviews, comments, photos, or other content (“User Content”), you grant Jewellaire a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content for operating and marketing the Services, to the extent permitted by law.

You confirm your User Content does not infringe third-party rights and is not illegal, abusive, or deceptive. We may remove User Content at our discretion.


12) Intellectual Property

All Site content and materials (logos, product content, text, graphics, photos, designs, and software) are owned by Jewellaire or licensed to us and are protected by intellectual property laws.

You may use the Services for personal, non-commercial use only. Any unauthorized use, copying, or redistribution is prohibited.


13) Third-Party Links & Services

The Services may include links or integrations with third parties (including payment providers and social platforms). We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.


14) Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain disclaimers, so some parts may not apply to you.


15) Limitation of Liability

To the fullest extent permitted by law, Jewellaire will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or business interruption arising from your use of the Services or products.

In all cases, Jewellaire’s total liability will not exceed the amount paid for the product giving rise to the claim (or the minimum amount required by law, if greater).


16) Indemnification

You agree to indemnify and hold harmless Jewellaire from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the Services, or violation of any law or third-party rights.


17) Changes to the Terms

We may update these Terms from time to time. Changes take effect when posted on the Site. Your continued use of the Services after changes are posted means you accept the updated Terms.


18) Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any disputes will be handled exclusively in the state or federal courts located in Houston, Texas, and you consent to jurisdiction and venue there.
